The La Case Foundation respects your right to data protection in the field of online communications when you use our websites and communicate with us electronically. We put in place all necessary measures to secure the personal information that you entrust to us. It is important for us to inform you that the La Case Foundation is responsible for the processing of personal data (please refer to question 18 of this Notice). The principles set out in this Notice apply to each data controller of the La Case Foundation. We have answered several questions that you certainly ask yourself about the personal data that you transmit to La Case Foundation. The answers to these questions inform you of your rights regarding your personal data and the measures taken by La Case Foundation to ensure the confidentiality and security of this data. 1. What personal data does the La Case Foundation collect through this site and how does the La Case Foundation collect it? We collect only the personal data that YOU want to provide us or those that are necessary for the proper functioning of our services. We collect direct personal data such as name, address and email address, as well as indirect information such as cookies and login and system information. You may want to provide us with your contact information (name, phone number and email address) to receive information about our activities.
2.How does the La Case Foundation ensure the security of your personal data? The La Case Foundation takes all the necessary measures to guarantee the security and confidentiality of your personal data. Only La Case Foundation’s authorized personnel, third-party companies (eg service providers) or business partners (who are committed to keeping such information confidential) have access to your personal data. All employees of The La Case Foundation who have access to your personal data are required to comply with La Case Foundation’s Data Protection Policy and all Third Party employees who have access to your personal data have signed an agreement confidentiality. In addition, contracts have been concluded with third-party companies that have access to your personal data, to ensure the security of this data. To ensure the protection of your personal data, La Case Foundation maintains a secure computing environment and has put in place appropriate measures to prevent unauthorized access (hacking). 3.For what purposes Does the La Case Foundation use your personal data? Your personal data will be used for the purposes for which you provided it to Nestlé. They will also be used to obtain your opinion on the quality of our services and to prevent security breaches, the law or our contractual conditions.
4.To whom does The La Case Foundation disclose your personal data and for what purpose? The La Case Foundation will never disclose your personal data to Third Parties for the purpose of using it for direct marketing purposes unless specifically authorized by you. As for the La Case Foundation’s policy regarding: (i) direct marketing by e-mail; (ii) your right to ask the La Case Foundation at all times not to contact you via commercial e-mails; as well as (iii) your right to erase your personal data from our system – please refer to Questions 8 & 5.
The La Case Foundation may share your personal data with Third Parties but only under the strictly limited conditions set out below: • We may provide your personal data to third parties (such as our Internet Service Providers) who participate in the management of this site. Some of these partners may be outside Switzerland. Our main hosting provider is in the United States. Please refer to Question 6 – “To which countries will your personal data be sent and for which purposes? “. These Third Parties must at all times provide levels of protection equivalent to those of Nestlé, and are contractually obliged to ensure the confidentiality and security of your personal data, and to treat them only as directed by the La Case Foundation. • We may also have to provide your personal data to public bodies or judicial authorities for legal reasons; or if we believe in good faith that such an act is reasonably necessary to comply with legal procedures; to respond to any claim or action; or to protect the rights of The La Case Foundation or the public. • We may, in limited circumstances, be required to forward your personal data to potential La Cart Foundation potential buyers, provided that (i) we have contractually assured that such information remains confidential and secure, and (ii) La Case Foundation complies with applicable national law when providing such personal data.
5.How can you view, modify or delete the personal data you have sent us? You are entitled to ask us to provide you with all the data in our possession concerning you. You may also request that your personal data be deleted, corrected or modified by sending an email to firstname.lastname@example.org or a letter to The La Case Foundation, Rte du Jorat 59, 1000 Lausanne 26.
6.What countries will your personal data be sent to and for what purpose? The server that makes this site accessible may be located outside of Switzerland. Our main hosting provider is in the United States. This supplier is bound by a contract which guarantees the same level of data protection as in Switzerland and which requires (among other provisions) that the latter act only at the request of the La Case Foundation and implement all necessary technical measures, permanently, to ensure the security of your personal data.
8.Online Marketing – What is SPAMMING and what is the position of La Caseen Foundation regarding SPAM (unwanted e-mails)? Spamming is the sending of e-mails containing advertisements or other commercial documents without the recipient’s consent. The La Case Foundation DOES NOT SEND SPAM. The La Case Foundation itself uses anti-SPAM software to protect its employees from spamming. Sending e-mails without the recipient’s consent is illegal in many countries. The La Case Foundation will not use your personal data (including your email address) for direct marketing or follow-up purposes unless expressly authorized by you. This authorization is called OPT-IN. In addition, The La Case Foundation will not transmit your personal data to third-party companies that intend to use this data for sending SPAM. La Fondation La Case’s websites offer you the opportunity to receive information by e-mail. Every e-mail sent by The La Case Foundation will give you the opportunity to terminate these mailings at any time. If for any reason you believe you have received a SPAM from a Nestlé Group company, please inform us immediately at email@example.com
9.How long does the La Case Foundation keep your personal information? Your personal data will only be kept by La Fondation La Case as long as it takes into account our need to respond to requests or solve problems, to offer new and better services and to comply with legal requirements. This means that we may store your personal information for a reasonable amount of time after you stop using the La Case Foundation or website. After this period, your personal data will be erased. We remind you that you have the right to have your personal data deleted at any time. Please refer to Question 5 “How can you view, modify or delete the personal data you have sent us? “(See above).
10.What is the La Case Foundation’s policy regarding the collection of data from children using our websites? It is essential to protect the privacy of children on the Internet and to encourage parents / legal guardians to accompany their children on the Internet to participate in and monitor their online activities. We do not collect any personal data from children under the age of 13, even with parental consent.
11.Does the La Case Foundation offer links to third-party sites, and what happens to my personal data when such a link is activated? The La Case Foundation provides links to other websites so you can access other interesting information. We can not control these third party sites, so they are not covered by this Notice. If you access other websites using the links provided, operators of these sites may collect your personal data. The La Case Foundation tries, as far as possible, to ensure that all linked third-party sites offer measures equivalent to those of The La Case Foundation in the protection of your personal data, but we can not be held responsible for their activities, their data protection conditions and their respect by these third parties.
12.What happens to my personal data when I send a La Case Foundation web page by e-mail to a third party? Some of our websites offer you the possibility of sending the address of a web page to a third party. For this feature to be operative, we may need to collect your email address and / or the email addresses of the people to whom you want to send the web page. E-mail addresses collected in this way are not used for any purpose other than to answer your requests. These e-mail addresses are not retained and are deleted as soon as your request is satisfied.
